The products of Engelbert Strauss AB (hereinafter called "engelbert strauss") are specially designed for professionals (customers that are not consumers) (hereinafter called "customer"). By placing an order for goods in the online shop, you undertake to use these for your independent, professional, commercial or offical activities only. These General Terms and Conditions shall apply exclusively. We shall not acknowledge any differing conditions unless we have agreed to them expressly.
By pressing the "BUY NOW" button, the customer makes a binding order that constitutes an offer of contract. Before submitting an order, the customer has the opportunity to check the details he/she has entered under "Final Check" and make any changes necessary. Once the order is submitted, an e-mail is sent to the customer confirming the receipt and showing the details of the order. This order confirmation does not constitute acceptance of the purchase for legal purposes, but is merely to inform our customers that their order has been received by Engelbert Strauss. The purchase contract comes into existence only with the dispatch of the goods ordered. The language of the conclusion and performance of the contact is German. Engelbert Strauss reserves the right to not perform as promised and to refund the purchase price to the customer in return if the goods are unavailable or temporarily unavailable for supply despite the prior conclusion of the relevant purchase contract.
Unless otherwise agreed, your Engelbert Strauss products will be paid for in cash on delivery. We deliver free of charge from an order value of just 1.250,00 kr including VAT (1.000,00 kr excl. VAT). If your order is for less than that amount, your delivery will cost only 73,75 kr including VAT (59,00 kr excl. VAT). Packaging costs are generally borne by Engelbert Strauss. We will deliver orders with promotional print on a pre-payment basis.
The delivery date of the goods depends on the selected payment method. Deliveries against pre-payment usually take about 3 to 5 working days (Monday to Friday, not including Saturday) once payment has been received. Deliveries on account usually take about 3 to 5 working days (Monday to Friday, not including Saturday) once the order has been received. If the goods are embroidered, printed or designed in any way to your specifications, the delivery date will be agreed separately for the specific order.
All prices quoted for you as a business customer are exclusive of the legally applicable VAT. This of course does not include requests for samples.
The goods remain the property of Engelbert Strauss until full payment of the purchase price.
If there is a defect in the goods, the statutory regulations on liability for defects shall apply. engelbert strauss shall assume no liability for damages incurred as a result of incomplete, late or non-delivery, if these are caused by fire, strikes, lockouts, force majeure or other circumstances beyond our control. The same applies if the incomplete, delayed or missing delivery by the supplier is due to one of the above-mentioned circumstances. In the case of non-delivery or a delay by a sub-supplier, Engelbert Strauss is entitled to withdraw from its contract with the customer, if the goods, despite the previous conclusion of a corresponding purchase agreement, cannot be delivered or are temporarily unavailable. engelbert strauss shall be obliged to inform the customer immediately of the unavailability of the goods and to immediately refund the consideration paid. Liability for slight negligence is excluded for damage caused by Engelbert Strauss. This shall not apply to death, physical injury or damage to health, breaches of cardinal obligations, i.e. such obligations whose fulfillment enables the proper performance of the contract and on which the customer usually relies and is entitled to rely, to warranties or where claims under the Swedish Product Liability Act (Produktansvarslag (1992:18)) are affected. This shall also apply to the actions of our legal representatives, employees or agents. Liability in the case of negligent breaches of essential contractual obligations is limited to direct damage. The legal rights of our customers are not waived by the foregoing limitations of liability. If no consensus can be reached, the customer can contact the Public Swedish Complaints Office. This office comprises a neutral chairperson and several representatives of tour operators and consumers. Also, the communal consumer advice offices can help. The customer can choose between the following payment options: credit card, Paypal, pre-payment or invoice with a 30 day payment goal. Engelbert Strauss reserves the rights to check the credit rating for this payment type. By submitting your order, you agree that invoices may be sent electronically (e.g., by e-mail) or by mail, at our option. The customer shall be in default if he/she has not made payment to Engelbert Strauss within 30 days of receiving the invoice or equivalent request for payment. Default interest will be payable on overdue amounts within the meaning of § 6 of the Swedish Interest Act (Räntelag (1975:635)). This customer is informed that dunning charges of 60,00 kr will be charged for reminders.

If one or more of these Terms and Conditions are or become invalid, this shall not affect the validity of the remaining terms and the validity of the contract in its entirety. The ineffective term shall be replaced by the term that comes as close as possible in its effect to the economic objective pursued by the parties with the invalid term. Section 139 BGB shall not apply.
